Waiver / liability release

P3 Training Waiver

I wish to participate in P3 Training. I certify that I am 18 years or older, or have my guardians

approval below, that I am a U.S. citizen and that I am not a fugitive, nor have I ever been a

convicted felon.

I understand that this training is inherently dangerous and I knowingly and willingly assume all

risk of injury or other damage associated with such training including death. I release all

teachers, students, and other parties from any claim of any and all liability that may result from

injury received, and I hereby waive all claims that I, or anyone else on my behalf, may make with

respect to such injury or damages. I agree for myself and successors that the above

representations are contractually binding and are not mere recitals and that should I or my

successors assert my claim in contravention to the agreement, I or my successors shall be

liable for the expenses including but not limited to legal fees incurred by the other party or

parties in defending unless the other party or parties are adjudged finally liable on such claim for

willful and wanton negligence. This agreement shall not be construed as a modification of any

other provision, or as consent to any other subsequent waiver or modification. I certify that the

information provided is true and correct to the best of my knowledge. I understand that the

information provided on this registration may be used to conduct background checks to assess

my suitability for this training.

Because this training is potentially lethal to myself and others, I understand that instructors may

shout and/or make physical contact with me during training should they recognize a situation to

be unsafe for myself or others.

COVID-19 WAIVER OF LIABILITY AND INDEMNIFICATION

1. I agree that I am personally responsible for my safety and actions while training at P3 Training L.L.C. in Alabama (Herein referred to as "P3 Training"). I agree to comply with all the P3 Training policies and rules, including but not limited to all the P3 Training, Last Resort Guns, and Arsenal Combat Sports Club policies, guidelines, signage, and instructions. Because P3 Training is open for use by other individuals, I recognize that I am at higher risk of contracting COVID-19.

With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue P3 Training, its board members, instructors, Michael Kase, officers, agents, servants, independent contractors, affiliates, employees, successors, owners and assigns (herein referred to as the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party using the gym, or otherwise, while participating in any activity while in, on, or around P3 Training, Last Resort Guns, or Arsenal Combat Sports Club and/or while using any of P3 Training facilities, tools, equipment, or materials.

2. I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising either directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the P3 Training facilities, tools, equipment, or materials, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.

3. By signing below I acknowledge and represent that I have read the foregoing Waiver of Liability, understand it and sign it voluntarily as my own free act and deed, including without limitation the Release of Liability and Indemnification requirements contained in this document; I am sufficiently informed about the risks involved in using the training area/range/gym to decide whether to sign this document; no oral representations, statements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by the same. I agree that this Wavier of Liability shall be governed by and construed in accordance with Alabama law, and that if any of the provisions hereof are found to be unenforceable, the remainder shall be enforced as fully as possible and the unenforceable provision(s) shall be deemed modified to the limited extent required to permit enforcement of the Wavier of Liability as a whole. This waiver remains in effect until the State of Alabama, Madison County and the City of Huntsville lift all COVID-19 related mandates.

Force on Force Simunitions/ UTM/ Airsoft/ Paintball Waiver

THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS
IN CONSIDERATION of P3 Training LLC, Last Resort Guns, Camp Liberty, Arsenal Combat Sports Club, and Hobbs Island Shooting Range (to include its parent companies, affiliates, officers, directors, and employees) AND Michael Kase, James Lam, Jeff Soulis, Jonathan Collins, Russell Berger, Zach Cole, Jeff Cramblit, and any affiliated instructors, coaches, employees, volunteers, staff, observers, AND other participants.

I agree as follows:
I {name} fully understand and acknowledge that: (a) risks and dangers exist in my use of
Simunitions/ UTM/ Airsoft/ Paintball equipment and my participation in Simunitions/ UTM/ Airsoft/ Paintball activities, (b) my participation in such activities and/or use of such equipment may result in my injury, including but not limited to death, serious bodily injury, disease, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, serious disability or other serious injuries or damages; (c) these risks and dangers may be caused by the negligence, gross negligence, or recklessness of the owners, employees, officers or agents of RELEASEES, as well as the negligence of the participants, the negligence of others, accidents, the forces of nature or other causes; (d) these risks and dangers may arise from foreseeable or unforeseeable causes; and (e) I hereby assume all risks and dangers and all responsibility for any resulting losses and/or damages, whether caused in whole or in part by the negligence, gross negligence, recklessness or other conduct of the owners, agents, officers, employees of myself, or by any other person. I, on behalf of myself, my personal representatives and my heirs, hereby voluntarily agree to forever release, waive, discharge, hold harmless, defend and indemnify the owners, agents, officers and employees of myself from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services, lost wages, economic damages, or other damage or losses that may arise out of my use of Simunitions/ UTM/ Airsoft/ Paintball equipment or my participation in Simunitions/ UTM/ Airsoft/ Paintball activities; I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future for the negligent acts, grossly negligent acts, reckless acts or other culpable conduct by the owners, agents, officers or employees of myself.

I HAVE CAREFULLY READ THE ABOVE WAIVER AND RELEASE AND, BY SIGNING IT, AGREE IT IS MY INTENTION TO EXEMPT AND RELIEVE RELEASEES FROM LIABILITY FOR WRONGFUL DEATH, PERSONAL INJURY, PROPERTY DAMAGES, ECONOMIC LOSS, OR OTHER DAMAGES OR LOSSES CAUSED BY NEGLIGENCE, GROSS NEGLIGENCE, RECKLESSNESS, OR ANY OTHER CULPABLE CONDUCT OR CAUSE OF ACTION.
